Sample Language For Charitable Gifts Through A Will

The provisions in a will for making a gift to St. Ann’s Foundation will depend upon the type of bequest and the donor’s circumstances. These sample provisions might be helpful to the donor and the donor’s attorney.

Unrestricted Gift

I give to St. Ann’s Foundation, 1500 Portland Avenue, Rochester, a New York State nonprofit corporation, the sum of $ __________ [or __________% of my estate; or the property described herein] for its general purposes.

Specific Legacy

I bequeath my home, farm, livestock, car, truck, etc., to St. Ann’s Foundation, 1500 Portland Avenue, Rochester, a New York State nonprofit corporation.

Restricted Gift

I give to St. Ann’s Foundation, 1500 Portland Avenue, Rochester, a New York State nonprofit corporation, the sum of $__________ [or property herein described], to be used for [specific fund or purpose. If restricted to endowment or a specific fund, you may want to include directions on how any income from this gift would be used].

Residuary Legatee

All the rest, residue, and remainder of my estate, both real and personal, I give to St. Ann’s Foundation, 1500 Portland Avenue, Rochester, a New York State nonprofit corporation, for its general purposes.

Contingency Gift

I devise and bequeath the residue of the property owned by me at my death, real and personal and wherever situated, to my wife (husband) _______, if she (he) survives me. If my wife (husband) does not survive me, I devise and bequeath my residuary estate to St. Ann’s Foundation, 1500 Portland Avenue, Rochester, a New York State nonprofit corporation, for its general purposes.

Final Contingent Beneficiary

I give and bequeath the residue of the property owned by me at my death, real and personal and wherever situated, in equal shares to my above named beneficiaries, if they survive me. If my above named beneficiaries do not survive me, I give and bequeath my residuary estate to St. Ann’s Foundation, 1500 Portland Avenue, Rochester, a New York State nonprofit corporation, for its general purposes.

Testamentary Charitable Trusts

Note: Testamentary charitable trusts may be set up (1) to provide life income to one or more individuals with the principal passing to St. Ann’s Foundation at the demise of the last income beneficiary, or (2) to provide income to St. Ann’s Foundation for a fixed time period, after, after which the remaining assets pass to the individuals designated.

 

While all of these examples provide unrestricted support for St. Ann’s, any of them can be designated or restricted to a specific purpose or program. Due to the changing needs of this organization, we ask that you consult with the Foundation office when considering a restricted gift.
